What is the statue of limitations in florida ?

My brother got in some trouble about a year ago. He has not seen a courtroom yet. Can he get out of it - if to much time passes ???

  1. That depends on the crime.

It depends on what crime he has committed.  Murder and some rapes have no statute of limitations in Florida.  If he has been charged the statute isn't running and isn't a factor.  If he has been charged in Florida he has the right to a speedy trial and if he doesn't get it he could force the charges to be dropped.  Wish you had told us what crime he committed, whether he was caught, whether or not he was arrested, etc. so we could answer properly.

  5. It depends on the crime. Capitol felonies, life felonies, or felonies that resulted in a death have no statute of limitations. First degree felonies are limited to 4 years, other felonies to 3, first degree misdemeanors to 2 years, and other misdemeanors to 1. However, prosecution "is commenced by the filing of an indictment, information, or other charging document." This does not require the person to be in court.
