What is the statuet of limitations in New York on an unpaid bill from 1990.?

My husband has received three letters from a collection agency regarding a bill my husband paid off in 1990. He no longer has any proof of payment considering it was 18 years ago. Any suggestions?

  1. 1990? Typical SOL is 4 years however that does not mean the debt is now uncollectible, the SOL means it can no longer be collected by means of law.  This sounds like an ancient debt that some lowlife collection agency purchased for pennies on the dollar and now is hoping to collect from him in full.  A certified letter needs to go out to hsi company within 30 days to demand two things:

    1.) proof of the debt

    2.) all communications cease at once unless to provide evidence to substatiante the debt is his.  

    Chances are you will never hear from them again.


  2. This debt is WAY outside the statute of limitations for all 50 states...it is also past the allowable 7-year reporting cycle on credit reports....so they can't place this on his credit file . It doesn't matter that your husband no longer has proof.  This is ancient, time barred debt....because of this, the collection agency is powerless over your husband....other than trying to scare/annoy him into paying.

    Send the collection agency a letter via Certified Mail + Return Receipt stating:

    Per the Fair Debt Collection Practices Act, I am requesting:

    - written validation of this alleged debt and that said alleged debt is within the statute of limitations

    - Cease all verbal communications with me about this alleged debt.
