What is the statute of limitations on a debt in kentucky?

My mother had an account with capitol one in 2000. She never paid on the account (bad I know). It has recently been bought by a collections agency and they are asking for payment. She is on Social Security now and cannot afford this bill. I heard that a Company can only request payment up to 7 years, is that true?

  1. Statute of limitations varies by State and type of debt.

    Credit card accounts are considered open accounts and in KY the S.O.L. is 5-years so the account is time barred from collection.

    Simply send the collection agency a letter stating that this account is time barred from collection activity and to cease and desist all collection action and communication with your Mother.


  2. Be advised that each state has it's own limiatations.  If you need to know what it is in your state,,, simple, call the State Attorney Generals Office, generally an 800 number and they will be happy to help you.
