  1. The plant in the photo is a Datura.

Brugmansia and Datura are two different species. About 25 years ago both were called Datura.

Brugmansias are long-lived woody perennials with downward-growing large 6-24" long trumpet-shaped flowers. They can reach a height of 20'.

Daturas are short-lived, herbaceous perennials, grown as annuals in most zones. The flowers are small 2-8" slightly outward-facing trumpet-shaped. Their seed pods are round to oval, and some species' pods are covered with spines.

All parts of both the Brugmansia and Datura are toxic especially flowers and seeds.

  2. datura, aka, jimson weed, angels trumpet.   Lovely plant but highly toxic. (Buds open in the early evening, correct.??

Don't worry, it won't make plants near it toxic.  Just get rid of it if you have children if any age .  They get the notion that they can "trip" off it, but it is way too toxic for peoplpe to fool around with.
