What is worst: 1st degree murder or 2nd degree murder?

First degree Murder: A murder that was planned.

Second degree Murder: A murder that wasn't.

Both are just as bad as eachother as the victim still died, but 1st degree murder is, in my opinion, more malicious.

1st degree is premeditated.... think about it.....

1st degree murder involves premeditation which makes you eligible for the Death penalty (california).

2nd degree murder has no premeditation element which can probably give you a life sentence.

for the victim it doesn't matter he or she is still dead. The main difference is whether it was planned or thought about before the act. As an example, a man comes home and finds his wife in bed with another man and kills the man. That would be 2nd degree, the murder arose out of passion without forethought. If he knew about the relationship and killed the man later it would be 1st degree.
