Agarwal dowry case: Plea seeking bail cancellation filed

Pune: The dowry case involving businessman Ram Kumar Agarwal and others has taken a new turn.
Agarwal’s daughter-in-law Priya has filed a criminal revision petition before the Bombay High Court (HC) for cancelling the anticipatory bail granted to her father in-law and others. The others include her husband Ajay Kumar Agarwal, mother in-law Reeta Kumar Agarwal and Nikhil Kapoor. The plea will come up for hearing before Justice V.C. Daga on June 10. Advocates Shrikant Shivade and V. Manohar will appear on behalf of Priya. Additional public prosecutor S.R. Shinde will appear on behalf of the Bundgarden police station.
Priya had registered a complaint against her family members with the Bund Garden police station for allegedly outraging her modesty, subjecting her to severe cruelty and demanding dowry under sections 354, 498 (a) and 506 of IPC and 3 and 4 of the Dowry Prohibition Act, on March 6, 2008.
Agarwal and others who were apprehending arrest had moved the district and sessions court here to obtain interim anticipatory bail. The court had initially rejected their interim bail applications. But, the fast track court judge S.J. Kale had later granted them anticipatory bail on March 14, 2008.
Priya has moved the HC to cancel the bail pleas on the ground that their custodial interrogation was required. The petitioner states that her father Yogesh Kumar Bail who is a Dutch national had met all the dowry demands of her husband’s family members after her marriage in 2007. Priya has charged her husband’s family members for allegedly misappropriating the money and other articles.
Meanwhile, the Bund Garden police have filed an application seeking cancellation of the bail pleas. They have also submitted a proposal to the state law and judiciary department, Mumbai, for seeking permission to move the HC for cancelling the pleas. The proposal is pending.
Senior police inspector Ranjeet Dhure, who is investigating the case, said that all documents and evidence for filing the chargesheet have ben collected. He said that police was ready to file the chargesheet against all suspects, but was awaitng its legal advisor for taking a final opinion.
