What is your experience with guardian ad litumn's?

Please tell me anything you can. We have to meet with one soon over my step-daughter and I want to be prepared. Do they come to your house? Is it when the child is there? What do they do? Are they fair? What happens in court afterwards? Do they just say what they think should happen and they the judge decides or do they decide or do they just give an opinion and then there are more court dates after that? Do the parents still have to agree with their decision or do they just have to do what they say? thanks for your help this is the first time I have done this.

  2. I depends on the situation and the State you are in.

    Usually the guardian ad litum meets with all parties, depending upon the age of the child the child too. If this is a custody case then a home visit is required.

    They make a determination on the situation based on their observations and make a suggestion to the court. In most cases the court will follow the suggestion of the G.A.L. then it is over unless you appeal the decision.

    You always have the right to speak up in court as long as you are respectful to the judge and all present. If you don't agree with the decision you have the right to appeal the decision. But then you have to decide how much of this do you want to put the child through.... look at the greater good.

    My experience as a volunteer has been that G.A.L.s are very fair and just in their decisions. They are trying to do what is in the best interest of the child, that is their job.
