ok so my fiiance has joined the military and the place where he works is giving him an extremely hard time about it. they didnt give him his full raise like he was supposed to get and he had a nearly perfect evaluation. and on top of it they didnt put his raise in when they were supposed to they didnt put it in till months later and now they have decided since he is leaving they wont give him his retro pay that he is entitled to. they have took him out of his department and gave him doing almost like janitor work. they didnt "demote" him as far as how much money he makes but definitly in the job he is doing..his manager tried to say he thought he was leaving this month but he has the papers that state when he leaves and its not for a few more months so that cant be the excuse....there is more issues but im not going to get into those....he has called human resources and they wont return his calls so the next step we have come to is take legal actions against him..to at least get the money he is entitled to since no one seems to be getting it....so my question is what type of lawyer should we contact. for example there is civil lawyers criminal lawyers malpractice lawyers etc. any suggestions would be greatly appreciated...i dont know if you need to know this but were in the state of FL.

  1. He doesn't need a lawyer, contact the FL state dept of labor to file for unpaid wages first.   They will do a formal request through their dept. to the employer for the missing pay.  If he doesn't get it then, all he can do is file a civil suit with any good civil attorney.  If it's less than the max$ allowed in small claims, go there, no attorney and just a $35 filing fee to get into court.  If he's got it all documented he's got as good a chance to win.

  2. Im sorry to hear about this.. if he's been at the same job a year or more contact workers comp maybe and see what they say..

theres tons of lawyers out there looking to help people out..

you could also google it and say exactly what type of lawyer and your state that your in and I'd bet you'll find tons of them that way.. best of luck

  3. you should contact an employment lawyer/labour lawyer

  4. Civil.  However, he will lose.  If bf has a contract he can enforce it.  If not, then each day is a new contract.  If he has announced he is leaving the company soon, for any reason, then he is less valuable to the company and his ability to negotiate a favorable contract for the next day is diminished.  If he is going to the reserves, the analysis is different.  If he has already earned something, he is entitled to it.  Raises and such, and work conditions, are subjecct to change if he has no contract.
