What kind of sentence can you get with probation violation and resisting arrest.

  1. It depends...based upon what you have written its impossible to tell...but folks don't get "locked up" for "sitting on abandoned steps"...was he trespassing, and then tried to fight the officers who responded?

    Worse case-boyfriend serves his probation sentence in county or DOC, with the additional time for resisting .

    Best case-the charges are dropped.

    Either way, your story doesn't add up. Why don't you get a copy of the police report and find out what really happened.

The quick answer is that "it depends."  However, if he committed a new crime while on probation, then it is likely the probation will be revoked and he will be sent to jail for the underlying sentence that was probated---e.g. 30 days in jail probated for 1 year means he would be sentenced to 30 days in jail.  Whenever a judge is confronted with a motion to revoke, he/she can either:

    1.  deny the motion

    2.  modify the terms of probation and continue him on supervision

    3.  grant the motion and revoke him and send him to jail (if on misdemeanor probation) or prison (if felony probation)

    I predict his probation will be revoked and he will have to serve some time in jail/prison unless he has a drug problem, in which he may be sent to an inpatient "rehab."
