What laws did my roomate break by kicking me out?

Wow this was such an experience. this girl allowed me to move into her place and i had my own bedroom. we agreed that i would help around the house buy groceries and buy her drinks here and there for the first month and then we would discuss more at that time. anyways, i think she wanted me in there for other reasons. i had one of my girlfriends come over and i cooked tacos for everyone and then the next day the roomate kicks me out of her house. she had one of her guy friends come in my room and demand me out while she waited in her room for me to leave. i couldnt get all my stuff in my car so i was gonna get it the next day. she then says i can only get it if i give her $100, she kept playing games back and forth and turned into a psycho. i tried going down there with an officer and he said it was civil. i think the officer was dumb or something because back home if something like that happens an officer can go to the house with the past resident and do whats called "keep the piece and get the stuff out.

what grounds do i stand on? what laws did she break? she wont even give my stuff back. isnt that theft? she is technically stealing my stuff... please help!

  1. she's mad because you can come home and make tacos for your girlfriend but can't pay rent!


  2. This isn't a rental deal, this is a personal arrangement between you and her.  Sounds pretty screwy, but she does need to let you in to get your stuff.

    If she won't let you in, you'll have to take her to small claims court.  No, the police won't act, because they don't know what right you have to anything.  Despite the other poster, the landlord also has no legal right to let you in, for the same reason.

    Personally, if it was me, I'd pay her the $100, get your stuff, then take her to small claims to get it back.


  3. No laws, but you are one very lucky dude.  Lucky some nut job did not do you harm.  Lesson learned something for nothing never turns out to be free.

  4. I would contact the landlord and tell him/her what happened and that you want your stuff back.  Let the landlord deal with it, then.

  5. Most likely none. No she can do what she likes, you don't own nor have a lease, you have no rights.  I'm sorry by there really isn't any help.

  6. We need more info - Is she renting or does she own the place?

    Either way it is illegal for her to keep your stuff.

    if she is renting - that is an entirely different set of laws and many other issues.

    EDIT: If she is renting it could have been illegal to have you move in in the first place. It is illegal to sublet under most leases. if she had done it right and had you move in with permission from the landlord, then only they can evict you.

    If your stuff has any monetary value- take her to court. she is definitely breaking many laws.
