Question:

What legal recourse do I have?

What is my legal recourse if I accept the written offer by making the requested payment within the time frame of the offer, and then they sell the remaining debt to another agency or attempt to pursue legal action. Should I write a letter to them first stating that I will accept these terms provided they release to me a settled and closed letter upon verification of payment? I only have fourteen days to do this.

  1. If you make the requested payment within the time frame of the offer, you have accepted the offer and the debt cannot be sold to another agency.  If you are worried about the terms of the offer, try calling them first - sometimes they will settle with you for even less than they are currently asking if you contact them and negotiate.  I'm assuming you're dealing with a collection agency regarding an old debt.
