  3. It is not stated in the U.S. Constitution. It  is a part of what I like to call the "unwritten Constitution". It is not stated but we have been doing it since the beginning our nation. An example of this is the Cabinet. No part of the Constitution says that the president must establish a Cabinet, but since George Washington did it, every president since has done it.

    Common law is the law of a country based on custom, usage, and the decisions and opinions of law courts based on previous decisions. This called a precedent.
