What might happen if decisions of the supreme court were not final?

  1. Sounds like a trick question! Supreme Court decisions are NOT final.  

    First, Congress passes a law and then the Administration implements it.  A person can sue the Administration for not implementing the law correctly.  The Supreme Court can decide in favor of that person or the Administration.  In either case, Congress can come back and modify the law - see the case history of the creation of the Do Not Call list!

    The reason is that the decision is based on the text of a law and not the Constitution.

    If the Supreme Court decides a case based on the Constitution, then Congress cannot overturn that decision by just changing a law.  But, we do have a procedure for amending the Constitution.  So if the Supreme Court decided it was unconstitutional to sell ice cream out of a truck, then we could amend the Constitution to specifically allow it.

    This is all about the balance of powers among the three branches of government.
