  1. Look for an attorney, legalzoom works as well as it is cheaper. Or go to the Secretary of State website for your state and refer to the Business sections where all the forms are located.

Forms will depend on the type of business your opening, LLC, Corp, S-Corp? If it is small business, I would usually think LLC.

  2. That depends on what type of business your looking into doing out of your home.  Most home based businesses you don't have to file anything when collaborating with a corporation.  Becoming and Independent Representative and running your portion of the business out of your home.  In this case, alls you need to do is fill out an I.R form from the company and they handle the rest.  If it's a business like a child daycare center, then you need to contact state licesning and they will tell you what you need to do for your state.  Each state is different.

Without knowing what type of business your going into I can't tell you the exact steps of what you have to do.  If you could clarify what type of business, I may be able to point you out in the right direction.
