i would like to marry my bf who is a permanent resident of usa before i leave for south africa in november. he plans on filing for his citizenship soon. i have 3 months left before going home so im nt sure what to do. can he file an I130 for me while im in sa and how long will it take till i can come to usa again. will they speed up the process if we file the I130 when hes a resident and then his citizenship gets approved? i am currently on a j1 visa and i have to go home when im done but im nt subjected to the 2 year rule. i dont wanna spen alot of time away from my bf as i love him very much so i need the quickest or easiest way to do this. any advice would be greatly appreciated

  1. You have a couple of options after he becomes US Citizen, which is must faster than PR (about 6 years of wait).

    1. Before marriage, your bf then fiance can file K-1 Fiance(e) Visa (I-129F) after you get engaged. The process will take about 8-10 months and the interview will be conducted at US Embassy in your home country. Enter US on K1 get married within 90 days and file Adjustment of Status (G-325A, I-485, 765, 131, 864, 693) and wait about 8-12 months until green card .

    2. After marriage, your bf then husband can file K-3 Spouse Nonimmigrant Visa (129F). Interview will be again in US Embassy.

    10-18 months of waiting and after entering US, file AOS and wait about 8-12 months until green card.

    3. After marriage, your bf then husband can file CR1 Immigration Visa (I-130). It is about upto 2 years of wait. When you enter, you will get green card.
