    1) It depends on both the state and county you reside in. Some states require all sorts of documentation (birth certificate, valid photo ID, social security numbers, etc.) while a particular county may only require one form of identification. For example, in the state of South Carolina, you need to have your social security number and a form of state or federal identification... UNLESS you're getting married in Charleston, South Carolina. All they require (if you're over the age of 21) is the foreign birth certificate and a certified copy of it translated into English (which can be done at any translation service for approximately $40). The immigrant will most likely need to sign an affidavit as well, stating that they do not have a social security number and are not eligible for one. So they will need to understand enough English to take a sworn oath before a county official.

    2) While a visa may be required to enter the country legally, you do NOT need a visa in order to get married. Marriage is governed by state laws - not federal laws. And as we've already established, each state has their own procedures in which to get married.  

  3. i married a illegal 6 years ago and was living in the state of oregon, all they asked us for was my id and his and thats all.. so if urin the u.s then i would just call up the courts and ask what u need.

    If you want to get married in America and not file for US citizenship, thats cool you can do that.

    If you want to get married and then live and work in the US.  You first have to apply for a K1 Visa, which allows you 90days to enter the US and marry.  If you've had problems with the law then that will cause issues.  You will be given a medical, and checked for HIV also.

    When you are here and married within 90days, then you file for AOS (adjustment of status) and a work permit.  You will also need someone who can sponser you.  You will be interviewed for the AOS, and if all goes through a 2 year card will be issued.

    Before the 2 years is up you then apply for the 10 year card, around the 3 year mark you can apply to become a US national.

If you are IN, and came in with a temporary visa, student or a holiday visa, go to the Consulate right away!  Some women just go ahead and marry the guy, then "forget" their stay in America is only for so many months - they become illegal immigrants! Do it right! It's for your own safety!

    If you come here with your birth certificate and no visa it is clear intent to marry. That is immigration fraud. You need to get a visa first.   8. If you are from a country that is a part of the Visa Waiver Program, you won't need to present a visa. Just your birth certificate and passport should be enough. (and the marriage license fee of course;)
