What proceedure to i take to sue a parent?

back in may i gave my mother $400 to deposite into her account to pay my electric bill and recently got a call that the check bounced now my electric is being terminated what should i do? please help.......

  2. Before you take legal action, see if you can solve this problem with your mother outside of court.  

    If you cannot come to any sort of agreement, you can take her to small claims court.  If you determine you need to take legal action, contact your local county courthouse and find out what their procedure is for taking someone to small claims court.

  3. Talk to your Mother. She is the one who is liable for the bounced check. If she won't pay you back the money, then you need to take her to court.

  4. Get the money to pay your electricity, ask your mother to be reimbursed, and don't trust her with your money any more.  Suing her is kind of stupid in my opinion.

  5. In small claims court (the appropriate venue here) the burden of proof is on you to demonstrate that you gave her the money in the first place.  You would also have to show proof of intent (what the money was to be used for)  You are probably out of luck with this one.

  6. Don't sue your mother.  Just talk to her about what happened.  Tell her that you need the money to pay your bill because your electric is being terminated.  Make sure she gives you the money and I guess to could go to small claims court if you had to.  In the future don't lend anyone money.  Put it in your own account and not anyone elses.
