Question:

What process is needed to marry a Filipino currently in the USA on a work visa; ending soon, could she stay?

she is a caretaker, and patient is expected to live ony 6 months. are there advantages to marriage while she's in the usa? is it even possible? And if it is,would a permanent visa likely be expedited?

  1. Well, if she marries someone American that she actually WANTS to marry then there are advantages. My mom came to America from Asia also to attend college. After she married my dad, who is American, she was allowed to stay because her spouse was American. Alot of people tell me it's easier to get you visa permanently if you marry someone American. But it really depends... she shouldn't just marry anyone random!

You seem to be in quite a rush for marriage, and while I understand your underlying circumstances I can't help but wonder a few things...how long have you known each other?  Did she seem quick to talk about marriage or more eager than you?  What ties, if any, does she have with the US?  What relief, if any, does she have to obtain citizenship in the US, other than YOU of course.  Please don't be upset with these questions, I only ask them in your best interest as someone who sees this kind of thing on an almost DAILY basis.  If she divorces you on your 2 year anniversary...well, just be careful my friend...and try to give this the time and careful consideration it deserves.

  3. I feel for your circumstance, however, your marrying without proper documentation is illegal. You are opening up a hornets nest unless you truly love this person and have wanted to marry her for a long time. The powers that be do not allow this type of marriage. She will have to go back to the Phillipe ans and then you must apply for a fiance visa. Do not go there unless you mean it as you will be prosecuted for lying to the government. I know this because I married someone from another country and went through all the legal process years ago. It is much more difficult today, and I had the advantage of wanting to marry my now husband and he and I are both from western nations.

  4. If you are a US citizen just get married to her.  Once you are married just file an I-130 (spouse petition) and the supporting documents with the CIS.  Also file for adjustment of status and for a work permit.

    Since she's here legally now, they will allow her to stay until the petition is approved.  It won't matter whether her work visa expires or not.

    If you only have a Green Card you can still get married.  However, there is a 5 year wait for a spouse visa.  They will NOT let her adjust her status.  They'll make her go back to the Philippines when the work visa expires and wait.

  5. I think you would apply to convert the visa to fiance, then apply for a green card after the marriage
