Question:

What right do I have legally????

We were gone a few days,,new neighbors were moving into the house next door that was for rent,,we look in the back yard, our mower and tiller were missing,,we see tracks in the grass going to the bent part of the fence going to the house next door,, we look through the wooden part of the fence and there they are!!!! We call the cops, the woman there appoligizes about 500 times and says she knows nothing about it, and that her boyfriend and his brother are not there yet, the cop writes stuff down and says he will give it to a dective,,,and that they will have to have proof that those people took the stuff!!!!like, WHAT MORE PROOF DO YOU NEED??????

I know that we got our stuff back,,BUT I still want to file some kind of charges!!! I am so angry that I threatened to shoot them if I ever caught them in my yard again,,I said this in front of the cop,,,I lost it... If they get away with it,, then they will just shop in my yard for whatever they want to take next, or break into the house,,

I have a lot of things to get done but now I am afraid to leave the house....What can I do??????

  1. Calm down! Multiple punctuation doesn't help anyone. I can tell by the way you write you're highly excitable and like to yell and scream at people. You already shot yourself in the foot by reacting the way you did - the cop now has seen you flying off the handle AND making threats. So in any further incidents, you will have to prove that you weren't aggravating them.

    Don't leave your property unsecured in the yard, and invest in a camera with a motion sensor and DVR system. If they come into your yard, then you'll have video of them trespassing.

    You should also notify their landlord about this. If you haven't already alienated your existing neighbors, let them know these new people are not to be trusted.

Unless you can prove that they are your items - do you have proof of purchase that shows a serial number?  you can't prove they're yours.  Unless someone saw them take the items, you can't prove they took them.  Talk to the cops and go from there.  It sounds unfair but thats probably what the cops will say.

  3. First off think before you open your that by itself can get you in a heap of trouble. I know it is frustrating and  what they did was wrong but get a grip and do things the right way.Chain up your stuff or get a shed with a lock on it or move at least you have a choice. But if you raise a bigger stink then you will have bigger problems because you are living right next to them and getting them mad isn't a good thing. Make sure you have renters insurance and getting a watch dog could help? Just some ideas. Hope one of them works for you.

Legally you have done all you can.  It's tough to accept, but legally you can not proove that any crime was done as you've described.  I try to speak with all of my nieghbors every other month or so.  This way, you have group support.  It is always best to first try to get along with the neighbors, but sometimes you must protect yourself with a good defense.

    You should consider some sort of video security for your home.  They have become very inexpensive.  You must consider the cost of your property to justify this financially; however, the personal violation of your privacy might be enough to justify installing a new security system.  The mere presence of camera's often will stop anything from happening, but if something did happen you would have PROOF of what happened.

  6. Call the landlord and tell the landlord that these tenants are no-goodniks.


  7. Lock your stuff up as best as possible, and follow up on what you said. If you see them on your property, shoot them.
