What rights do I have as a tenant of a business space if I have no written lease? I could not make full rent.?

We were in contact the whole time about starting a new business and building it up. He knew we couldn't make the full rent..and had many emails and meetings about it. He was willing to work with us. He locked the doors on us with no notice after reading an e-mail I wrote that said, we no longer can keep the business because we can't make the money. Then, said he will be keeping a part of my personal items to pay for the rent we could not make. What are my rights? I was served no eviction notice, just locked out with my things inside. plus he said I can't have something that I own inside. Help!

  1. A commercial landlord has more rights than someone who is renting out their house.  You are expected to be a more-knowledgeable tenant.  He can lock you out 5 days after you miss your rent payment.  The email had nothing to do with it.  But i don't like it when landlords are mean.  He should not keep your belongings hostage.  In some states he must return the tools of your trade and a few other items.  Hang around the building as much as possible to watch over your items.  Ask the landlord if he will release some items in return for a little cash.  A little is better than nothing. Your options are few and they are all bad.


  2. With out a written contract you are pretty much screwed. You legally have no right to go on to his property if he locked you out as you have no proof you were ever allowed in there   Eviction notices are only to protect the landlord when kicking someone out before the lease expired but since you had no lease he did not have to get one. You could try going to small claims court to get your items back but it will be a long shot.
