What rights does a father who's name is on the birth certificate has, children live with mom?

Parents are not married and the father helps only with groceries and snacks and sometimes clothing. He takes them to movies, to eat or mall, very rare. But I do not get a check or cash on a monthly basis.

  1. In the state of georgia both parents have to be married at the time of conception or the father has no legal rights to the child. The only option that the father has is to have the legitamized through the court system. It does not matter who is on the birth certificate. Anybody can be listed as a parent on the birth certificate.


  2. The father has equal rights...If they live with you full time he needs to pay child support, but you might need a court order for that. If I were you Id talk to someone from the child support enforcement office to find out more.

  4. Well, did you ever go to court to establish custody and child support? If you haven't, you should.

  5. get child support....  but honestly unless he signs over his rights then he has the right to have them when you both agree on a time. for things to be better and more of a schedule then you will have to file for child support and they will set up visitation for him.

  6. Even if you are not married he has the same rights as you do. You have established paternity to the children by having his name placed on the birth certificate and therefore attested that he is legally the father.  If you want child support and his rights to visitation on a schedule or monitored you'll have to bring the matter to court.

  7. well in the state of Arizona if you are not married the father legally has not rights to the child...Meaning he takes the child somewhere with out you knowing its kidnapping..I would just talk to lawyers or something to find out more..

  8. I am a father of 2 handsome boys, Josiah turned a year yesterday the Eric turned a year in may. If i want to see Eric I have to drive 6 hours round trip on a friday then 6 hours round trip sunday. I do the best i can i do pay child support but if i want to see him i have to pay an additional 200 to 300 a month in gas just for the gas. When i try to get her to meet me 1/2 way i have to pay for her gas. I would like to see him weekly but i cant afford it. If i were you id go for child support. If you can afford a lawyer (which i cant or else i would have visitation set.) get visitation rules set to where the court will decide how much and or how often he can see his kids.
