What rights does a renter have without a lease.?

my son's rent was paid to date, but the landlord evicted me by locking the trailler,denying him to enter, posting a charge for storing his things and charges in arrears for his pet.. The police told the landlord he could only do this after a 30 day eviction notice, but he did not honor this.

  1. Get a lawyer.  You won't get any specific advice on here without telling us what state you live in, because they are all different.

    Look in the phone book..  there is often a free legal council service in most metro areas.


  2. even with out a lease , if you son has been there for more then 30 days then the landlord/owner can NOT just lock him out.  it is in the eyes of the law his home and they need to give him notice..  

    tell your son to climb in a window or kick the door in..  let the landlord call the cops,  they can not arrest him, it is his home. renting or not.  

    as for charging him for storing his things, have him try and take him to court and the court will tell the landlord he gets nothing and may owe your son money for locking him out of his home.

  3. You kind of have a problem proving what the terms and conditions of the rental were with no contract. Whats stopping this shady landlord from acting the way hes been acting so far and lying in court? Yes it is illegal but that doesnt seem to bother him so far.

  4. Your son needs to go get an Attorney .

    A LOT of his rights were violated !!!

    He probably won't even have to pay the attorney as the court WILL make the landlord pay the attorney fees and court cost ....

    He needs to get into an attorney ASAP !!!

  5. Go to a website called legalmatch.com and type in your problem you have to register but it is free and it will forward it to all attorneys that deal with cases like this. I use to work for an attorney and I worked with this program myself like I said it is for free you do not need a credit card or anything really a great service

  6. Your son is the one who had his possessions locked up, so he has todo the followup:

    Get a copy of your state's Landlord Tenant laws and see what his remedies are ... in AZ he could sue the landlord for up to three months rent as a penalty for unlawful eviction.

    Small claims court is where you will go.
