What rights has my landlord got in regards to entering my room without permission?

Ok, he entered my room without me in the room and took money which he assumed was rent. He never gave me any notice at all. Is that legal?

  1. He has no rights to enter your room, with out prior permission. And even then if you do not wish him to enter, its your legal right to say no.

    As to taking the money, that is theft, and seeing he had no permission to enter your room in the first place, it can be classed as burglary. If you wish to pursue this, the police will be helpful.

    One thing you have not said, is if the landlord lives in the house also.

    You need to put your concern es in writing to the landlord, stating, you do not give permission for him to enter your room at any time. And if the missing money is not returned with in 7 days, you will be contacting the police. And then I would start looking for another room.

    Legally, it depends on the laws of the land where you live and the contractural stipulations of your rental agreement.

    Rarely do morality and legality coincide.

  3. Which country? In the UK you CAN refuse permission unless there is some clause in your contract that allows for things like showing people around.

    When you rent, you rent the space and the landlord can not enter without your permission.

    However if your contract does allow visits then the landlord has to notify you a reasonable time ahead and you can still refuse.

    It is dependent upon the purpose of why your landlord is going into your area. Is it to repair something?

    Ok, I see the problem......the taking of the money is not right - it does not matter if he made an assumption - he has that premise to enter if he has a reason - fix something or things like that but not to take money - unless you told him to do so.

    Realize, if you press the issue then you can encounter problems with him in regard to renting - so if you decide to push the issue then I suggest you find another place to live.

    A preventative measure is to review your lease agreement / you should have a copy / if you do not have one then you need to request a copy / inform your landlord in writing that you would like notice before he enters into your rented area. Of course, he may not oblige - I suggest you make sure it is in the lease - and that some one else is present to hear it by chance.

    I would talk a put a camcorder in a hidden place and catch him on tape and see exactly what he is doing - is he actually repairing or maintaing something or is he going through your things - and if he is and you have it own tape then you can pursue charges against him - possible lawsuit as well.

    There are certain types of shops that sell item that can help you to hide cameras or they sell the pinhole cameras that are like in a teddy bear or a book - look online and you will be able to find it.

  9. You get 48 hour written notice unless there are flames coming out from behind the door; in which case she can go inside to put the fire out.

  11. take him to small claims court for the money and sue for no notice properly served and entered also, what time a day is important law says" mon - fri normal business hours to enter is law . sue the b*****d california law says  it!
