What should I be asking for in child support court?

I have to be in court this month for child support. I filed a violation of support order on my husband because he was working and not paying. He's currently not working (again!) and I'm not sure exactly what will happen considering he has no money to pay. His arrears will be over 2000 dollars by the time we go to court. Not sure what to do....

  1. how much he pays is determined by the court based on income and time with the child.  If you has no money, he has no money.  Eventually he can be tossed in jail.  Unless he has a job where they can attach his wages, it is hard to impossible to collect.

    Raised my step son from 6 to nw 24....never one cent from his dad.


  2. You need to still ask for the money because it is owed to you and the kids, regardless if he has a job or not. You want to always keep a paper trail and document everything, so that when the kids ask questions in the future about why Daddy is looser; you can show them the paper work of him lacking consistent employment to feed and shelter them and not being the Man he was destined to be.

Laws are different in every state I know that once you hit the 2000 mark of back child suport here in michigan they issue a worrent for your arrest also they have absent parent job seeking classes that will be issued and if he gets a job through their the state garnishes there wages straight from the first check recieved. The bad thing is concidering he doesn't have a job anymore than his payments could be lower extremely.... good luck

Go ahead and make your court date; the court will not lower or cancel his current support order even if he isn't working and the arrears will be documented.  If your support isn't already set up to come through the courts, you need to ask to have that done as well.  Unfortunately, this is a tactic that is too often used by deadbeat parents; but, depending on the State that you are in and how well they enforce the Child Support order, he could end up with his Driver's License revoked and/or serving jail time.  Good luck.

  5. You need to go to court and make sure that he pays the amount set up for him to pay. The courts do not care that he is not working, he better get a job, arrears are piling up. If he is far enough behind they can take his license and that includes drivers license, business license, whatever. Here in GA they are also taking car registrations. They can intercept any tax refunds or whatever. Go to court and get whats owed to you to raise your child.
