What should I do about a construction contractor who refuses to reimburse me?.?

I hired a contractor to construct a 12x18 garage. I gave him a $5,000 deposit to place my project on a calander with the stipulation that it be completed by a certain time. He never produced a contract in the three months that he promised to complete the project, so I fired them. He did offer to return the $5,000 in 4 different emails over an 8 month period. He asked that I sign a release and the $ would be in the mail. He them decided to take anothe $1,080. from the $5,000 for work after he was fired. My attorney wrote a letter asking for an explaination of expenses, the contractor's attorney left my attorney a voice message saying he would be unavailable for comment. The contractor then emailed and wanted to renogiate the amount. I gave him $65 which was what I paid my attorney to tell me about the voice message.

The contractor now says his company was forced to engage an attorney and now the mutually agreed upon $5,000 is no longer returnable. What next?

This is terrible!  You absolutely must sue him; I would also try and contact the local TV stations and get this losers name/company name out there so others do not have to endure such stress.  I'm really sorry to hear this...Kiro and komo TV are pretty good about exposing these kinds of criminals.
