What should I do if I bought a car and the seller refuses to smog it? And who pays repairs if it fails smog?

Since he's the seller and is by law responsible for it passing smog which he didn't do....was this sale valid? Can I bring him to court to get my money back if he refuses?

I believe that in california is the law for the person who sells the vehicle to smog it before he or she can sell it. i would check with the DMV.also the DMV will pay a partial amount to get it repair....

It depends on State to State. I doubt you could bring him to court. But then I am not a Legal adviser.

Try your local DMV. The DMV may penalize him for doing so. Also they may choose to reimburse some of the repairs.
