What should I do with my Insurance company?

Hi, I got hit by a old man 5 weeks ago. Ovbiously I live in FL c**p place full of c**p guys of 80's and up . got my eclipse 2007 2 months ago, I was on my way to the bank to take money, when got hit on my left side by a old guy in his lexus. rear bumper, wheel, tail light, skirt, back door panel and my 2 air bags deployed a total of 7K to get fix. I was scare to get my car totalled cause it only have 4.000 milles. anyways. I took it to the shop they told me to wait 1 month, one week ago they said to wait 'til June 6th. I called today for an update, and they said that they'll get an confirmation on the 6th if the air bags are available otherwise they'll have to customize some and that might take up to 6 months. that c**p is ridiculos I don't know what to do and the worst part my insurance won't cover a car rental on my name cause I'm 21. my dad has the car but he won't let it to me. Can i do something about it? can I get my 18k of my eclipse and leave??

  1. you need to go take your car to a different body shop...I would suggest the dealership if possible as they are able to get your parts no problem!  if the insurance company gave you the option to total your car, they will only pay you actual cash value for it, NOT what you owe on it.  You would need GAP insurance to cover the difference.


  2. You can't get your 18K.  You beef is with the autoshop.  The airbags are available for that model car and they are blowing smoke up yer rear.  

    Tell the insurance company -- in writing -- that you are not going to settle for (customized) air bags and that you are contacting an attorney.

    Then look at the back of any local phone book and call that attorney and tell him your plight.

    If you have a shot at winning a case the attprney will take it on a contingency basis ( no cost to you ).

  3. I would report your insurance company to the Insurance commissioners office and  the body shop to your state office of consumer protection.  It sounds as if the body shop is jacking you around and the insurance company is allowing it.

    It shouldn't take over a couple of weeks to have everything fixed and your car back on the road.  An Eclipse is just a normal car, not needing anything special.  If it were a Rolls Royce, I might say a couple of months is reasonable.  Don't let them stall you any longer !
