Question:

What should I expect in child / spouse support when my soon to be x husband leaves the house?

We live in Florida. We have a 4 and 7 year old. I have been a stay at home mom since the birth of the 7 year old. We have been married since 2008. My husband is seeking divorce. He still lives in the house because I don't have a job and money is tight. He is talking about doing a quick claim. Is that a good idea? I can't affort an attorney but I don't want to sign something if its not what I should be getting. Does anyone know what I can expect? He makes 100,000 yearly. Oh, if you know of any free or cheap attorney help that is available that would help too. I want to do what is right and fair...thanks.

  1. He will need to support your kids with child support, but I think you may need to be married 10 years to recieve allimony.  Each state is different.

  2. Go through the SRS in your city/ county. They'll handle all the paperwork. It doesnt cost to process the paperwork. They only charge a very small fee (like $2.00 for every 100 he'll owe in child support, and it'll be taken out before you get it)

  3. If you don't get a lawyer and are willing to do things taking his word for it, you will totally be ripped off. A quit claim deed means you are giving him your interest in the house and getting nothing back. If you don't ask for child support, you will probably not get it, considering you are letting him handle all the details.
