Question:

What should I think or do?

My brother turned himself in last night, after the police came to my mom's house with an arrest warrant earlier. They stated that they had been doing surveillance on my mom's property and that he was on video selling drugs to an undercover agent on June 4th in her back yard. They want to charge him with Selling a controlled substance in a school zone, as her home is near the jr high school.

This is a bit confusing and suspicious to me because if they caught him on video completing the sale, why wasn't he arrested then? My brother also informed me that he new he had a warrant prior to returning home because he was advised by some of the local guys that they had been stopped by the police and asked if they were my brother. He said that the guys even told him that the police were looking for him. Wouldn't they recognize my brother when they see him if he is on video selling to one of their people?

This is a very small town and I'm just wondering if there is a case or set up?

  1. if its really a small town like really small then the police can consider him as a big dealer of the area, depending of the substance and priors they may just have wanted to get more charges so that they would be able to put him away for a longer period of time. if they were looking for him and knew that he would be selling at your moms then they might have waited to get him for the school zone + the sale and the prior warrant. if hes been encarcerated before they will go harder on a repeated offense and even worse in a third when they can request to adjust the sentence ++ and it makes their case stronger and easyer honestly if the guy is just not getting it. if this is his second and he gets out the police will be on his *** for a while, not a set up per say


  2. I'm sorry your brother admits to selling drugs and you want to help him beat the charge??

    They can arrest your brother when ever they want or are finished building a case against him.  Likely they had servailance on him to see if he'll lead them to a bigger fish.  The officers that came to serve the warrent probably didn't see the video.  

    I understand wanting to support your brother during this but you need to realize HE'S A DRUG DEALER.

  3. Police are generally very cautious before they arrest someone for selling drugs. Reason being, they want the charge to stick. They would have taped your brother selling the drugs, done a lot more investigation (to see if the homeowners were also involved) and waited until the judge and prosecution viewed the tape and cleared a warrant.  Your brother will want to get a decent attorney and you thank your lucky stars they didn't end up arresting your mom for it happening at her house.

  4. Did he confess to the police when they arrested him? At this point, if has remained silent or said he is innocent he is in good shape under one condition. That condition is, if they actually have a video or other evidence.

    I live in a small town too and there is this boy "Joe" who they have been trying to catch for years, but they never get evidence to prove anything. They have used scare tactics like "We have videos of you" and such. He always just remained silent and nothing comes of it even though they know he is guilty because they don't really have a video or evidence. So like I said, it really comes down to what he has said when interogated by the police and what evidence they actually have.

    As for you, you sound like you need a nice relaxing hot bath so you can chill out and think about things! Do you read books? I do that while soaking to keep my mind off of problems

  5. How can your brother turn himself in if people came in with a warrant? It sounds real enough to me the people who have seen the video tape doesn't have to be the officer, the undercover agent could tell the officer to collect a certain person hence the officer not recognizing your brother. Depending on your state and the laws their it might just be a misdemeanor (or that they need to take it to court anyways, they do use video evidence in court cases). If it is a felony they still need to bring him to court even if the evidence if obvious, he has a chance to try to defended in court, or would you rather that part skipped?

    Added: I suppose I sounded meaner than I was intending, hopefully your brother turns out straight, either way it sounds like you care for him, just support him either way I guess.

  6. Just because you are looking for him doesn't mean you don't know what he looks like. You should think your brother is a drug dealer and probably selling to those young jr. high kids. You should think your brother is a scum bag.

I'm going with you ..........don't admit to nothing without help....it's been to long........unless he's in to a bunch of stuff....then the time delay could be understood but hang in there if you think you are not guilty..............cops are sinners just like us...........white or blace or green.........make em prove it.

  8. It doesnt really matter if it is a "case" or a set up.

    They can arrest anyone at anytime for anything , the court decides if they are guilty or not.

    Here is your defense, obviously the police video footage is not that great because they didnt even know who to arrest they just got his name off of the address they were taping at.

    "Thats not me" is all he needs to say.

    You have to be proven guilty beyond a reasonable doubt in our country and a video that the police obviously cannot positively identify someone on will not hold up.

    Then again, there will be the officers testimony and most likely it will be " Yes, im sure it is him your honor"

    In which case, the officers character and history as well as his vision or any other dis-crediting problems the defense can come up with come into play.

    If hes guilty just admit it or shut up.

  9. Just be there for your brother, right or wrong he is someone you love.

    Love should be unconditional yet doing a "tough love" stance if he's being naughty must also be given with love.
