What should an affidavit consist of in a custody case?

I am going through a divorce and have plenty of people to fill out affidavits against my ex. I have all informed them that it shouldn't consist of bashing her as a person but to inform the courts of how poor of a mother she is. Any suggestions?

  1. No bashing! This makes you look bad, not her.  In this letter, these people can mention her temper, how frequent she yells at a child, how often she calls names, how often she gets a sitter, if she cooks meals or buys frozen dinners, who bathes the kids, puts them to bed, who cleans the house, how often she goes out, who helps with homework, etc. BUT no bashing of 'sexual behaviors' this is something you do if you want to loose the case, a judge hates the typical spitting matches, so keep it tame and thourough!


  2. Your witnesses should only relate what they have seen with their own eyes. Nothing more, nothing less. No opinions, facts only. They should include any conversations they may have had directly with the person in question, not relate what they heard from others. Again, they should stick strictly to what they know for a fact and leave out the hearsay.
