i had a accident yesterday down a single road the car the other side had two passing places but she ended up being on my side of the road. It was a blind corner so as soon as i saw her i went on the grass to avoid her as she didnt move into the passing place and we ended up scraping each other and she says it was my fault and she is trying to claim on my insurance and i also have a witness to say it was her fault but she still says it was my fault what should i do???

  1. I've heard its always taken as 50-50 on single track roads but if you have legal protection they'll help you.  If not leave it up to your insurance co and don't admit any liability.

  3. Explain everything to your insurance company and tell them that you are adamant it was the other party's fault and that you will go as far as court to prove it.

    They will argue this with her insurance company and by the sound of it they will probably win and you'll get your compensation and your no-claims-bonus if you have one.

  5. Anytime you have a crash, it's a good idea to report it to the police in case you suffer injuries a week or so later. At least you are covered that way, legally.

    It sounds like the other driving may have been speeding and couldn't negotiate the corner?

    Good that you were able to manoeuver yourself out of the way to prevent a worse crash.

    Insurance and witness statements will have to suffice if you haven't reported this to the police.

    Number one rule when ever involved in a crash is to never admit fault, because it can come back to bite you! That's probably why the other driver denied being at fault.

    You may end up in court, but deal with the insurance first, and talk to a lawyer too, who will give you proper legal advice.

    Lawyers also know how to present your case in a court of law.

  6. Of course she is going to say it was your fault, if she accepts responsibility her insurance will sky rocket.  Just tell your side of the story and make sure you witness does the same.

    Return to the site and have a good look, take photos if they will help then send everything, including the witness details, to your insurer and let them deal with it, thats what you pay them for.

It certainly sounds like its her fault!  You need to ring your insurance company  and give them the details of the incident, the womans details and your witnesses details, they will sort the rest out for you. The same thing happened to me, the woman refused to give me her insurance details and was adamant it wasn`t her fault ( even though it was and 3 wittnesses to say so!)  i just gave my insurance company her registration details and everything was sorted out, within 3 months i recieved a cheque for my damages.  Good Luck!

  11. When she makes a claim and you on her insurance, the insurance companies will battle it out, including contacting any witnesses for statements.  It could be a long drawn out process and in the meantime you will probably have to pay to get your car mended yourself.

  13. You should have called the cops on the spot and have had them speak to the witness and draw their conclusion as to whose fault it was. I'm guessing you didn't do that. So now just make sure you and the witness gives the accurate and detailed report as to what happend to the insurance company and in court (if it ever goes that far).

    As far as the other driver saying who's fault it is, its not up to her to decide that.

  15. is there anyway you had taken pictures at the scene, usually that can help and the court can make reason out of it. i find it hard to see how she can say its your fault? whats her crapy story?

  16. take her to court you have a decent case you'll probably win a small lawsuit. but since she is trying to claim on your insurance you should probably take her to court and get an attourney not a public defender.

  17. Don't admit to it being your fault. Make sure of it. Also, call your insurance company to see if she how much of a chance she has of winning that case. The insurance companies will probably fight it out, but it sounds like she is in the wrong and you have a good chance.

  18. Press ahead with your claim. You have the witness, she hasn't. It is obviuos she will claim its your fault not to make a claim on her insurance and not to lose her NCB.

  19. When you make the claim, just tell them exactly what you've put here with a signed copy of a witness statement. They have a way of finding the truth ;-) You'll be fine.
