What should i do if a police accident report has screwed up facts?

Alright. It was raining out pretty bad and i was at a green light and i was turning left. There was no cars comin that i could literally see.....theres a hill... So I turned left and went straight for about 100 ft and a car slammed into the side of me. right at the right side corner of her street. Now im pretty sure she was taking a right when she hit me because of where she hit me and she spun me around in a 360. to make a longer story short, the lady cop gets there and doesnt give anyone a ticket or warning, even tho the lady in the car admitted she slammed on her brakes when she finaaly saw me. So i just got the police report and it says it my fault and these are exact worded statement about me that i "completed the left hand turn", "that i had a green light" and about her were "She believes she had a yellow light", "she said to of slammed on her brakes", "that she said car#1(me)decided to 'gun it' " and that "she was going straight" So its all screwed up, she completely took the other lady's side and im gonna be fucked for my insurance..... is there anything i can do or am i f***ed?

    I'm sorry to hear of your recent collision. The best advice I can offer you on this situation is to document everything to the best of your ability. Think the incident through thoroughly. Hire an attorney and contest the matter in traffic court. Arguing with the officer who cited you will not have the desired outcome you seek. Use the system that's in place. You should be able to find an attorney to reasonably represent you. If necessary you may ask for your court costs to be covered. All of this will take time and money. You may want to ask yourself this question though. Will your insurance rates go up higher than the costs and aggravation of litigating the matter?

  2. You can take it to court and go take pictures and make diagrams to explain what truly happened. The woman has to tell the truth (well is supposed to) in court and she can agree or nullify the diagrams with her testimony. It's an easy fix. That's just another traffic court case. Point out all of the "thinks" and "believes."

  5. If you were turning left, and she was turning right, she would have had the right of way, and you would be at fault.

    As far as the officer's comments... I see all of them started with "she said", so she is not s******g up the facts, she is just documenting what the other driver stated.

    It is possible the physical placement of the cars supported the other driver's story. However, regardless of what the officer says, the insurance companies will ultimately decide fault. I wouldn't worry about an attorney yet, until you hear from your insurance.
