What should i do to get my wife of 7 years to get legal? she came to the US from AUS in 2000 on a visa waiver.

She entered the country in 2000 and we married in 2001. We now have the money to afford the forms, but I don't know where to start.

I was born in the US and am myself a US citizen. I make about $15.00 an hour, 40hrs a week and we have one child together - I'm not sure what the financial eligibility requirements are.

I just want to get her to the point where she can get employment as soon as possible and not be in fear of deportation. Any help would be very appreciated!

  1. I hope she's got her Oz passport and the I-94 she got at the port of entry.

    You file I-130, I-864 and G-325A.

    She files I-485, I-131, I-765 and G-325A.

    The total cost to file is $1,365.

    File them all at the same time, in the same envelope.

    She should get the work permit in 90 days or less.

    She should have her interview with USCIS in about 6 months.

    She should get the green card in the mail in about a year.

    No matter what anyone tells you, this is the legal way to do it, she does NOT have to leave and your marriage is NOT fraud.
