What should my sister do in this situation?

My sister has needed health insurance for a while but she is too overweight to qualify but has no diagnosed health conditions. She recently applied for health insurance and just fibbed about her weight about 20lbs worth. When she went in for a physical she told the doctor she had irregular periods and sometimes anxiety. Well the health insurance company is trying to have her explain why she did not disclose the "pre existing conditions" on her application and to send them an explanation. While I know she lied on her weight she honestly had not been diagnosed with anything prior to aquiring the insurance. Can she go to jail if they found out she lied about her weight? My sister is willing to pay the claim from the doctors office to avoid further problems but is that enough?Can she just pay the claim herself to avoid any legal problems. Please do not be too harsh. She is really scared about what can happen to her.

    The worse the insurance company can do is cancel her policy.

    Don't worry about it.  


  2. First of all, being over weight isn't nesecarily(Sp) a disablity.. And lying?? if she don't come clean it will haunt her as life goes on..

  4. she definately would not go to jail, the insurance co. could not prove she just didnt weigh herself on a faulty scale, the first answer was correct in my opinion, the policy might not be valid.

  5. this is really sad...i hate how things like insurance work. but anyways..id say shes got a good arguement. she wont get into trouble but this is just my opinion...im no expert so i hope you get some good answers

She won't go to jail but she will probably have to pay any expenses billed to insurance because of lying.  The insurance company can terminate her insurance because of fraud.  Oh and just so you know a pre existing condition is a condition in which you have sought advice or treatment for before you were insured.  So if she does lose this insurance she had better tell her next insurance company about these conditions because she will be held on fraud.  She spoke of these problems with her doctor so they are now considered pre existing.  

  7. She won't go to jail.  Her insurance may be invalidated.
