What states will allow you to get married with an expired visa?

I am trying to get married to someone that has an expired student visa. We went to the courthouse today to get our marriage license and she said that state law requires you to have a current visa or passport. He came to the u.s. legally to go to college and his student visa is expired. We are not getting married so that he can stay here, we are getting married because we love each other and want to spend our lives together. Can someone please give us some good advice?

  1. Here is some bad news for you.

    His visa has expired and puts him in illegal status.  There is no state in the US that will validate his illegal status so you can get married, as this is a Federal issue -- even if you truly love each other.

  3. No state will give a marriage certificate to an alien with an expired visa. He will have to get an extension or reapply for his visa.
