What steps do I need to take in order to get custody of my nephew?

My brother just got out of prison and his girlfriend just went to prison. My nephew is being pushed from home to home. He's only 1 years old. I just want to have custody of him until she gets out. Any advice would help.

  1. Have the parents sign a temporay custody papers and date it for a couple of years. I took care of my nephew after his dad died and the mother couldn't care for him (she got on drugs) after a year she got cleaned up and over her heartach and took her children back. I missed them but they needed their mother. That has been 16 years ago and my nephew turned out great. He married and has a son and is in the army.


  2. it depends who has the child rite now. if the child is in the foster care system they will generally jump at the chance to place them with a family member but if the mother left the child in the care of someone or if the child has already been placed with another family member for example her mother then you would have to prove that the person who has custody of the child is not capable and then try to get custody.

  3. God bless you.  I can't answer your question, but I'd say keep trying until you find out.  That little guy needs a stable family member to care about him.

  4. I agree that the best way is to get a custody assignment from the mother and the dad.  You will need to agree on some kind of "end" demarcation (not just when she gets out of prison but when she gets and has maintained a paying job for 12 months, for example).
