the above link will give info on what happen and why I'm taking that guy to court. but a little update informations -

the guy that hit my car isn't going to pay for the damages, I filed a police report against him and to my auto insurance company.

Here's my question - would I need any document(s) from my auto insurance company stating that they check with DMV and it shows that he didn't have insurance on the car and that my insurance company won't cover my car (i have liability)?

This is what I got so far to prove my case:

1. pictures of the accident

2. police report

3. cost to repair damages on my car from 3 different auto body shops

This will be my first time suing someone so any info/ advise from you will greatly be appreicated.

Thanks!

  1. I think you may want small claims court. As long as the police are on your side then you pretty much have a done case. In some states the 100% of fault most be in the other party for them to pay restitution. Or everyone pays there own damage.
