yesterday i was in a car wreck hit pretty much head on. My cousin was driving and his gf was in the front passenger seat. i was in the back passenger side seat. My friend was hurt and is now on crutch and i have bruises all over my stomach and its swollen. The other car was speeding and came out of no where but we got the ticket. We are taking it to court but does anyone have any ideas what may make our case stronger? what kind of details?

  1. If you went to emerg straight away (as you should have) their report would be key.  Also it sounds like you could have internal injuries, nothing to mess with either way.  If you haven't gone, please see a doctor or someone.  The validity of your injuries depend on the timing of your treatment.  If you wait too long, you could sabotage your case.

    Also, you should also be represented by a lawyer.  If your cousin was in the wrong lane at the time off the accident and the fault lies with him, you can sue his insurance company.

  6. Get the police report and insurance company should be notified. The driver (since he got the ticket) should contact an attorney for advise. The driver of your car should have his insurance pay for your medical bills.

  8. As a former claims investigator, the minute I saw the words that the other car was speeding and came out of nowhere, I knew that the driver of your car was at fault.  The majority of at fault claim the other car was speeding.

    Did you pull from a stop sign.   What do you mean "head on."  My gut tells me that t his was a front end collision but not "head on."

    What was the point of impact on both vehicles.  What were the charges on the ticket?

    In some jurisdictions, if the other driver doesn't show up in court, the judge will dismiss the case since ther in no plaintiff present.  This does not mean the driver is absolved of their duties to pay for the damages to the other vehicle.

  9. who's fault was it ?  you really  need to go through your insurance and claim for all your injuries. if you are fully comp, it shouldn't matter who's fault it is, the only thing you'll loose if it was your fault is your excess.
