What to do about a hot water system which is too small for the house

My mother is renting and every time there is a gust of wind it blows the pilot light out. The hot water also does not last long at all, your lucky to get a 5 min shower out of it, if it hasn't gone out. My question is... is the landlord responsible for replacing the hot water system as it is a basic requirement to have hot water?

  1. It can depend on the rental agreement but in most cases the answer is yes the landlord is responsible. And hot water in my state is considered a "health and welfare" issue and they are required to respond within 48 hours and repair within another 48 hours.

    The term "health and welfare" is the magic term that gets a response. You can call the state about such issues if you don't get a response.

    And I doubt it is "too small". It isn't working right. If it is of any size it should provide a decent shower with no problem. Turning up the temp gives you more hot water (when mixed with cold).

    Don't concern yourself with the size until after it is fixed. Then check the temp. with a thermometer. I would guess if you are getting that little hot water the pilot may be out already by the time it is being used.

  2. Yes. The landlord is responsible and depending on how old the hot water tank is, it could be dangerous if it's gas. When the pilot light is out on some tanks the gas is still on, which means it is seeping into the air. In most states you have the right to request that the tank be replaced and if refused or delayed, you can pay to have the tank replaced yourself and deduct it from the rent. Hot water is a must for sanitary purposes. You have to show proof that you paid by giving the landlord the receipt with the rent. Check with your county's landlord/tenant rights before hand to be sure.

  3. Yes, landlord is required.  How old is it?  Could it just be limed up and needs to be cleaned?  Is the temperature turned up far enough? The dip stick could be broke, so its only pulling cold water from the top.  Convince the land lord that electric is cheaper now, with the raise in prices of natural gas, maybe this will convince the landlord.
