What to do if a dealrsip sold me a car that they didnt have a title for?

I bouguth a Ford Mustang from a dealership in March of this year. I still have not received the plates for my car. I have had to go back three times to get temporary plates. I did call them today because my temporary plates are again about to expire. They informed me that they did not have the title that it was being held un in probate in Ca. I live in Texas and I know they have 21 days to get me the plate and transfer the title to the lein holder. What recourse do I have?

  1. One obligation of the seller in any automobile sale is that they MUST provide you with a CLEAR title. Failure to do so is what is causing your problem.

    You can legally have the sale rescinded for failure to provide the title. You would give the car back to them, and they would refund your money. How did you obtain financing without a CLEAR title?


  2. I'm sure that dealership is in violation of Texas DMV regulations. You pretty much have that dealership by the short hair. If you want to return it, there's not much they can do. I hope you have not been making payments on it, if so you should be able to get back ALL your money. Also, if you're paying car insurance, you're paying for a car you don't own, get that money back.

  3. I hope you still have all the paperwork.  They've sold you a car that they didn't own.  Strictly speaking, you don't own the car either.  The party whose name appears on the title owns it.

    I recommend you return the car and get your money back.  If they push at keeping some of your money to pay for your use of it, push back with them having caused emotional distress and time lost for unnecessary complications.

    They cannot push back with their own time lost.  The title is their job, not yours.  They should've had the title in hand before they ever attempted to sell the car.
