What to do if the DMV wrongfully took my friends Driver's license?

My friend's license was suspended for tickets a year ago. Well, he paid the tickets off, went to court, and took care of all the paper work, and he got his license back. Now, he went to get his registration for a vehicle, and the DMV and court say his license is still suspended and that he never made the payments. What can he do?

  1. Pull out the receipts or bank statement showing the transaction to the court.

    If he doesn't have any record of payment, well then he'll have to repay them, because the court won't release payments if their records show it's not paid.


  2. Show them receipts and paperwork from the court.

    Maybe his license isn't still suspended but it's suspended again.

  3. Most DMV's have a reinstatement fee. Even though the courts are paid off, there is still probably a DMV fee to be paid. Also, the DMV has no way of knowing that his fee were paid unless he goes to the DMV himself with the paperwork showing the proof. What you need to do: Call the DMV, find out where to take the court papers to, and how much the DMV reinstatement fee is. (it's $50 in WV)

  4. Make an appointment with the supervisor at the DMV  office and explain the situation

    Request a hearing if no corrective action is taken, prepare proof of payment /clearing of violations to present at the hearing and if not satisfactory retain an attorney to repesent you for the court case that will follow as you sue for wrongful termination of driving privileges

    The local "legal aid society" or Bar Association can refer you to an attorney specializing in administrative law.

    Have the legal action prepared ahead of time in case there is no satisfaction you can then proceed to them setting a hearing/court date.

  5. Show them the copy of the paperwork from the court indicating that the fines were paid off and that he is in good standing.
