What to do legally with my foreign wife without harming my children in the process.? Post # 1?

Before I start, I want to say that my wife has a green card trough my sponsorship in the USA. been Married five years and have two kids.

From the moment my wife arrived into this country I have nothing but h**l all this time. I love my kids and I am affraid that if I start rocking the boat I might loose them forever. She already told me that she will go back to her native country and I will never see them again. Worse she does not want them either. She keeps saying that she will give them to strangers before me and start a new life for herself all over again. Yes we have two kids but I still don't know how it happened since our intimacy happens once evry months or two. And If that ever happens is because my wife feels sorry for me. Anyway my wife's moral character is the following:

Works under the table and pay no taxes - (refuses)

Starts business with illegals aliens in this country.

See my post to your #2.  When you file for annulment/divorce (which you MUST do! see post #2), also file for sole custody.  Since your wife is not a citizen, and has threatened to abduct the children, and you are filing based upon her defrauding you, and she is conducting criminal enterprises, you will get sole custody.

You must get a attorney, file for annulment/divorce based on her defrauding you for the purpose of obtaining immigration benefits, file for sole custody, get her out of your house/apt. (or move you & kids to another apt. this weekend!), and turn her in for immigration fraud, illegal-alien trafficking.  

Act quickly enough and you get the kids, and she cannot get her hands on them and escape.  She is going to jail & deportation where she belongs.

Get an attorney and get going urgently -- today.  She endangers you and the kids in a number of ways.  You have dithered too long.  Do not wait another day.

As for her taking the kids back to her country: Unless she already has passports for them, visas, they were born there, etc., that is highly unlikely. Even so, you could always file for Emergency Custody, citing the reasoning being that you feel your wife is endangering the lives of your children by aiding illegal immigrants dodge police. It also helps to document everything your wife is saying to you. A pocket tape recorder or video works best. If you do not have those things, you can simply keep a journal with the dates and times listed along with anything threat she may have said (i.e. - giving the kids to strangers & starting a new life).

You can also report her to the IRS for working under the table. Regardless, I would consult an attorney. They will usually charge between $50 and $200 for a consultation. Take all that lovely money you found in her closet or whatever and go talk to one!

In a marriage either parent can legally take the children and go wherever they want. My suggestion to you is to file for divorce and sole custody then get a restraining order. That way she can't legally take them anywhere. Make sure the court is aware of all of her activities.
