What to do when a false witness lies to the cops?

My ex boyfriend told the cops I scratched his car. The key witness, a lady who was no where near the car the time this happened, lied to the cops and said I did it. There was no weapons found and she was the only witness. However, she is an avid drug user and dealer. In addition, I have a witness that can attest that my ex had "drug user" behavior just a few days ago. What kind of evidence should I bring when I go to court?

  1. If your attorney can prove the lady is lying on the witness stand, that is perjury and it is a crime.  If it does not go to trial and the police find out beforehand the person is lying I believe they can be arrested for ubstructing justice.  If I were you, I would have a talk with your attorney and have his investigator look into the witness's story.


  2. Were YOU there when he claims you scratched his car? (I ask because if you weren't there, how do you know the key witness wasn't there?)

    If you were there, and you know she wasn't there, then definitely bring that up in court. It would help if you had some of your own character witnesses to explain that she is not a very trustworthy witness.

    This can be a very serious criminal matter although on the surface it appears to be very trivial.

    Hire the attorney who you think is the most supportive of your case and has good experience winning at trial.

  6. You can't go into court and say that everyone is lying because they are druggies.  It sounds like something a little kid would say as a defense.  You need something more....reliable, undeniable.

    Where were you when the car scratching supposedly happened?  Do you have proof?   A receipt from shopping?  A gas receipt? A witness that can put you anyplace else?

    That is what you need - not an excuse or finger pointing.
