What to do when in an Auto Accident and the other drivers spouse threatens and harasses you?

I was going slowly around a curved road when the other driver came around the same curve into my lane & hit the front end of my truck. We both stopped & decided to pull out of the middle of the road. The other driver parked on the shoulder & I followed behind her. During this time, she called her husband who lives right down the road, I had called my Mom. A minute later her husband arrived & pulled up threatening that is going to kill me. Right after, my mom arrives with the police. The other drivers husband is calling my Mom & I every name in the book & the woman who hit me had to ask the Cop to go & calm the husband down. The Cop refuses & tells her to get back in the vehicle & wrote me a ticket for crossing in the other lane. He never got my side of the story! I told him I did not cross but he said because of the location of damage it had to be my fault. Many cars have driven over the debris before he got there. Leagally, what options do I have with the Husband and perhaps the Cop?

  1. There is nothing you can do about being yelled at.  As for the citation, you can go to court and "tell it to the judge".  Good luck.


  2. haha.. wait.. do you think you can "sue" the husband and cop and get money or something?  If so LOL.. god i love america.

    You dont have any "options" for the husband and cop. The cop did his best to determine liability off the facts he had and the husband did lay a hand on you.. and sure if you want to try to get him in trouble criminally for "verbally assaulting" you go ahead and file a report.. good luck.

    You do have the option of telling your insurance carrier your side of the story and hopefully since it is word vs word they will agree with you.    They will then pay for your damages and attempt to get your deductible back from the other carrier.  But since you have no PROOF the other lady was at fault.. its not going to happen.

  3. If someone threatens you with bodily harm, and you believe they are capable of it, then you have been assaulted.  

    If they actually lay hands on you, that would be "assault and battery".
