What type of Visa to apply for? I want to marry my boyfriend, who is in the US. his student visa is expired.?

We've been dating for about a year and his student visa was expired before I even met him... he was travelling in Texas last week and was picked up and is now in jail. I want to marry him so he isn't deported, but the lawyer we hired is not being very helpful in explaining the process to me.

  1. Ok first go to library and get married. Then file a EOIR 42A

    Petition for cancellation of removal.

    After u get married u file that I mean not u, U have to go to the lawyer. after the lawyer filed that. the judge ( immigration judge will decide) If hes approve then congrats if not then sorry.

    Usually judge consider that when you can prove that you will suffer and you need him .

    Everyone knows that we cant live wtihout our love ones. but for immgration they dont buy that.

    if someone i disabled, cannot make up the rent or wil suffer or needs attention coz she or hes sick. then that cud be.

  3. A fiance visa may help, its only good for 90 days though. Maybe he can adjust his status? I'm no expert, you may want to ask at this site:

  4. The fiance visa (i-129f) would require him to leave and then come back after the visa process is complete. it seems that either way you want to go, he will still have to be deported. for more information, call the USCIS customer service center at this number:

    ps. ask them about the I-129F and the process to sponsor him a permanent resident card. they will tell you exactly what to do.

  5. Plan on him being deported. If you get married it will not stop the deportation process. If you got married before he was arrested... Sorry but if you want to live with him it will have to be in his country of origin , at least at the start.
