What type of college savings plans will allow both parents to withdraw money if they are divorced? I know some 529 accounts allow spouses to be joint owners if they live at the same address. This is not my case. We currently have the kids money in a 529 account in my ex-wifes name. Unfortunately this is not working well. Whenever we have a college expense that needs to be paid from the account, she generally refuses to withdraw the money claiming that I should pay the expense since the kids live with me. She then usually goes on to explain if the kids move in with her she would be more inclined to pay. I really don't wat to get into that too much here. When we went to court, the judge was willing to have the money moved into another type of savings plan. I know I won't get anywhere trying to have the money moved into my name; and I don't really want to go down that route if there are other options available. I could put it in the kids names also I guess. Any ideas??
