We decided to break our lease a month early due to the closing of our house being pushed up...So we went to court for breaking the lease in April and signed documents stating that we would pay a certain amount a month and they would mail the documents to us so that we know when and where to make the payments...2 months pass by and still no documents from them and so I called them to question them about it and they said we will send the paper work out and 2 more months later still no documents until today we receive a letter today to go back to court for them to garnish wages...I just need to know what type of lawyer do I call because we want to get rid of this debt and aren't hiding from it but the company is making no attempt to contact us besides court letters which also have no address to mail the payments to...Please share your advice if u are knowledgeable about the situation.

  1. Forget the lawyer, it'll cost an arm and a leg and won't really hep you any (its a pretty clear cut case).

I'd just go to the court and see what they say about garnishing your wages.  Since you were planning to pay them anyhow so maybe its no biggie if they just take it from your wages automatically.  Also talk about the problems you've had and maybe the judge will be sympathetic and cut you a break somehow.

  2. You are far too early to spend money on a lawyer.  What you need to do is visit the complex in person and make arrangements to pay in full as you agreed.  Then, in return, you get a properly signed document from them that your obligation is fulfilled, your lease properly terminated, and an agreement to drop the legal action.

You should have communicated with them from the start via mail, certified with return receipt requested.  Then you would have all the necessary documentation you now need.
