What types of questions can my potential employer ask my previous employers?

I took a test, did the interview, took a drug test and now I am waiting for a call back for a job offer. I have never done drugs and never been in jail ever..So the HR rep told me she would call me within 5-7 bus days and its only been 4 so far. They have to wait for my background and drug test results to come back. I'm worried about my last employer and that they may say negative things since i only worked there for a few months..My job before then i worked for almost 7 yrs. What types of questions can my potentially new employer ask my previous employers when conduction a background check?

  1. Depends on the state.  In Florida you can ask if the person was discharged or if the person left of their own will.  You can not down the person because we are a right to work state.  But just remember that its all about how they talk.  If someone says oh he was a great employee in an upbeat voice, it is WAY DIFFERENT than if they say it in a very low and un-interested voice.


  2. They can ask whatever they like. for legal purposes your former employer will only answer a handful of questions such as:

    Was this person employed with your company?

    What was this person's position with your company?

    Did this person terminate employment on good terms?

    Was this person convicted of any law breaking while employed with your company?
