What was the supreme court ruling from 6/26/08? Reasonings??

there was a supreme court landmark case from 6/26/08 relating to the 2nd amendment ( right to bare arms) and i was wondering what the ruling was, the reasons behind majority opinion, reasons behind dissenting decision, impact on state gun laws, the congress' reaction to the decision, etc. Also i would like some personal opinions on this decision and reasons behind them. thanx!!

  1. The debate was because of the use of the term "militia", which now has a different meaning than when the Constitution was written.  The term "Militia" was derived from a British Common Law practice of calling free men to arms using weapons they already owned, and required men to own such weapons for that purpose.  This practice goes back to William the Conqueror (1027-1087, K of Eng. 1066-1087), and was reflected in laws passed in all 13 colonies requiring every able bodied free man to own a musket or rifle.  What we now think of as a "Militia", such as the National Guard, would, back then, have been considered a "Standing Army", and it was to prevent such a force from being used to impose a tyrannical government on the people that militias were deemed essential in a free society.  When people argue that the 2nd Amendment makes no mention of private ownership of weapons they ignore the fact that at the time a militia was commonly understood to mean private citizens using their personal arms protecting their individual communities and lead by officers elected by themselves, not to any form of federally directed or supervised force, which means that no such mention would have been thought necessary.  It must also be remembered that all other provisions of the Bill of Rights directly address individual rights, which would make it anomalous for the Second Amendment to be any different.  In my opinion, for the reasons given, I think the Supreme Court made the right call, I just find it troubling that it wasn't by a greater margin.


  2. They ruled it was unconstitutional for the gun ban on Washington D.C. citizens will now be allowed to own guns but with very strict restrictions. I believe this is the right decision because it states in our constitution that all law following citizens will be given the right to bear arms. ( Its how we won the Revolutionary War )

  3. They upheld certain gun rights and protected our constitution. This is extremely important because right now if the US came under attack, it a secret that we dont have enough military in this country to protect us so it would hve to turn to the armed citizens to protect it. Crime will always exist whether we have laws to stop it or not and unfortunately things dont look so good for our near future either
