What will I be asked in a rape case?

My guy friend has been falsely accused of a rape crime. The girl's mother is trying to get revenge on my guys friend's dad. The victim is pregnant with someone other than my friends kid. My is going to trial, because there is no evidence and it happened two years ago "supposibly." I know what really happened from what she told me on the phone because she was a really good friend of mine. What questions will the attorneys ask me!!? oh yeah my guy friend wants me to testify in his defense

  1. just keep things simple im sure he will be found innocent.

    the court will dismiss your phone conversation as their is no proof it took place. (unless it was recorded)

    at the trial they will need to prove whos baby she is carrying

    your guyfriend can suggest prove a motive why this allegation is being bought up 2 years later i.e say she is blackmailing you (which is also a crime)

    but in court the "burden of proof" is on the prosecution to prove to a jury "beyond reasonable doubt" that a rape took place.

    i.e you dont have to prove anything just keep your mouths shut and deny everything.

  2. Unless you have personal knowledge of the incident and not hearsay, you will not be allowed to testify in the criminal trial, not matter what your friend wants

  3. Because the victim spoke to you directly, the hearsay rule does not apply. You can be asked questions about the conversation, and the comments she made.

  4. You should demand that the defense attorney prepare you for at least three hours.  

  5. The prosecution will definitely ask the conversation that happened  between you and your friend concerning what really transpired of the alleged rape. They would like to determined if your guy friend is the one who rape or this is just a make up story to frame your guy friend.

    Yes definitely you are allowed to testify in defense of your guy friend. The questionaire of how close are you with this girl? ' she is a friend of mine'- how would you describe your friend if you do not mind...you will describe her obviously to the court of what is she like, wild or just right for a girl of her age, does she got so many relationship during those past years? Mostly the question centered on your girl friend not necessarily your guy friend or even you. So make up a list of the characteristic of your girl friend, likes and dislikes, relationship over the past years, academic in schools etc. and most important the good side and the bad side of the girl. To simply defend your guy friend your answers should be all positive otherwise the court might have doubts on your credibility.  

  6. As no one here knows what the evidence is, or what the case is about, or what you know, or why you are being called as a witness, no one here can predict.  You will be asked to relate what you saw and heard at some unknown time.  

  7. What ever she told you on the phone and don't add to it because it could make matters worse. Unless you have proof of this incident, solid evidence, your better off staying out of it. A DNA test will prove who the father is.
